These Terms of Service govern your use of the HotSpot Electronics website and purchases made through our online store.

By accessing our website, creating an account, placing an order or purchasing a product or service from us, you agree to these Terms of Service.

Nothing in these Terms is intended to exclude or restrict any rights that cannot legally be excluded under New Zealand law, including rights that may apply under the Consumer Guarantees Act 1993 and Fair Trading Act 1986.

4. Product Authenticity and Third-Party Brands

HotSpot Electronics takes product authenticity and accurate product representation seriously.

We do not knowingly sell counterfeit goods or deliberately represent third-party products as genuine products manufactured by another brand.

Where a product is described as an Apple, Samsung, Oppo, Huawei or other branded product, the brand name is used to identify the product offered for sale.

Some accessories may be made by third-party manufacturers and designed to work with branded devices. Where applicable, these products should be identified as compatible or third-party products rather than being represented as products manufactured by the device brand.

Apple, Samsung, Oppo, Huawei and other third-party names, logos and trademarks belong to their respective owners.

Unless expressly stated and independently verifiable, HotSpot Electronics does not claim to be an authorised dealer, official store, franchisee or endorsed partner of these third-party brands.

5. Product Images

We aim to use images that reasonably represent the products offered for sale.

For pre-owned products or products with variations in colour, packaging or cosmetic condition, an image may be representative.

Customers should rely on the complete written product description, stated product condition and specifications when making a purchase decision.

6. Prices

Prices displayed on our website are in New Zealand dollars (NZD) unless otherwise stated.

Prices may change from time to time without prior notice.

The price applicable to an order will normally be the price displayed when the customer places the order, subject to correction of an obvious pricing or technical error.

Any applicable shipping charge will be displayed during checkout before the order is completed.

We will not intentionally advertise a misleading price or promotion.

7. Product Availability

All products are subject to availability.

We make reasonable efforts to keep inventory information on our website current. However, stock levels may change because of:

HotSpot Electronics does not control approval decisions made by independent payment providers.

10. Shipping and Delivery

Shipping charges, delivery areas, estimated delivery times and other delivery conditions are explained in our Shipping Policy.

Customers are responsible for providing complete and accurate delivery details.

If an incorrect or incomplete address causes a parcel to be redirected or returned, additional delivery costs may apply where reasonable.

Where HotSpot Electronics arranges delivery to a consumer, we will deal with delivery issues in accordance with applicable New Zealand consumer law.

Delivery estimates are not guaranteed arrival dates unless we have expressly agreed otherwise.

11. Returns, Refunds and Exchanges

Our procedures for returns, exchanges, refunds and change-of-mind requests are explained in our Returns, Refunds & Exchanges Policy.

Our voluntary return or exchange policy is additional to any rights customers may have under New Zealand law.

A policy condition relating to a voluntary change-of-mind return does not remove statutory rights relating to faulty or non-compliant goods.

12. Consumer Guarantees

Eligible customers may have rights under the Consumer Guarantees Act 1993.

Depending on the circumstances, goods supplied to consumers must meet applicable guarantees relating to matters such as:

Any such warranty is additional to statutory rights that may apply under New Zealand law and does not replace those rights.

The expiry of a manufacturer warranty does not automatically determine whether a customer has rights under the Consumer Guarantees Act.

14. Pre-Owned Products

HotSpot Electronics may sell pre-owned or previously used electronic products.

Pre-owned products may show cosmetic wear consistent with:

  • Their age
  • Previous use
  • Advertised condition grade
  • Product description

A condition or cosmetic characteristic clearly disclosed before purchase will not itself be treated as an undisclosed fault simply because the product is pre-owned.

This does not affect rights relating to faults or characteristics that were not properly disclosed.

15. Phone and Device Repairs

HotSpot Electronics may provide repair and diagnostic services for eligible electronic devices.

Where applicable:

  • We may need to inspect or diagnose the device before confirming the final repair requirement.
  • Customers should back up important data before submitting a device.
  • Customers should remove unnecessary personal information where reasonably possible.
  • Some repairs may require third-party parts, suppliers or specialist repair services.

We will provide repair services with reasonable care and skill as required by applicable New Zealand law.

16. Trade-In Services

HotSpot Electronics may offer trade-in services for eligible devices.

Trade-in values may depend on factors such as:

  • Device model
  • Storage capacity
  • Age
  • Cosmetic condition
  • Functionality
  • Activation-lock status
  • Market value

An initial estimate may change following physical inspection.

Customers submitting a device for trade-in confirm that:

  • They own the device or have legal authority to trade it
  • The device is not stolen
  • Any finance or ownership obligations relating to the device have been disclosed
  • Personal accounts and activation locks will be removed where required

17. Personal Information

Personal information collected through our website or services is handled in accordance with our Privacy Policy and applicable New Zealand privacy law.

18. Customer Accounts

If you create a customer account, you are responsible for:

HotSpot Electronics does not treat consumer protections as automatically excluded merely because a customer is purchasing for a business.

Any agreement to contract out of applicable Consumer Guarantees Act provisions must satisfy the requirements of New Zealand law.
